1. Acceptance of Terms

By accessing or using the services provided by Realty Lead Garden ("Company," "we," "us"), you ("Client," "Agent") agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Description of Service

We provide an AI-driven lead generation and nurturing platform that includes:

  • Automated AI chatbots for lead engagement.

  • Integration with third-party CRM software.

  • Automated SMS and email follow-up sequences.

3. Client Responsibilities & Compliance

The Client is solely responsible for ensuring their use of the service complies with all local, state, and federal laws, including but not limited to:

  • TCPA (Telephone Consumer Protection Act): You must ensure all leads have provided "prior express written consent" before the AI bot contacts them via SMS.

  • Fair Housing Act: You agree not to use the AI or the data provided to engage in any discriminatory real estate practices.

  • Account Security: You are responsible for maintaining the confidentiality of your CRM API keys and account credentials.

4. AI Performance and Limitations

  • "As-Is" Basis: Our AI bots are provided "as-is." While we strive for high accuracy, AI can occasionally generate incorrect or "hallucinated" information.

  • No Professional Advice: The AI is a lead-nurturing tool, not a licensed real estate agent, lawyer, or financial advisor. It is the Client’s responsibility to review and verify all information provided by the AI to a lead.

  • Service Availability: We do not guarantee 100% uptime, as our service relies on third-party providers (e.g., OpenAI, Twilio, CRM providers).

5. Fees and Payment

  • Subscriptions: Services are billed on a [Monthly/Annual] basis.

  • Cancellations: You may cancel your subscription at any time; however, payments are non-refundable for the current billing cycle.

  • Third-Party Costs: You are responsible for any fees charged by your CRM provider or SMS carrier (e.g., Twilio usage fees) unless otherwise stated in your plan.

6. Intellectual Property

  • Our Property: We own all rights to the AI prompts, proprietary code, and software used to deliver the service.

  • Your Data: You retain ownership of the leads generated through your account. However, you grant us a limited license to process this data to provide the service and improve our AI models (on an anonymized basis).

7. Indemnification

You agree to indemnify and hold harmless [Your Company Name] and its employees from any claims, damages, or legal fees arising out of:

  1. Your breach of TCPA or other telemarketing laws.

  2. Any real estate transactions (or failed transactions) resulting from the use of the AI.

  3. Your misuse of lead data.

8. Limitation of Liability
